Texas Property Code indicates that a lien release should be filed with the County Property Records Office after the claim has been paid and no later than ten (10) days after the written request has been received. In other words, time does not start until the request to release a lien has been sent to the contractor/supplier in writing. You must also make sure all the checks given to you have been cleared and the debt is 100% satisfied before signing the lien release.

All lien affidavits (construction liens), Sworn Statement of Accounts (document attached to a bond claim), and lien releases must be notarized and filed. Bond Claim Sworn Statement of Accounts are filed with the Surety Company on record, and they should be mailed via Certified Mail with Return Receipt Requested.

The county appraisal district websites are free and can provide you with the project owner’s name, mailing address, and legal description of the property. Make sure to search the real property records and not the business/personal property records. To locate a county appraisal district website search online by typing (county name) Texas tax appraisal district website. For example: “Harris County, Texas, tax appraisal district website” or “Harris CAD.” Then select their “Property Search” link and enter owner’s name and/or street address to search for property information. Make sure you have identified the correct legal name of the owner of the property, it could also be a company name. Finding property information in the tax appraisal websites is sometimes difficult and although having the legal description in the lien documents is preferred, if you know the actual street address of the project, you may use that instead and your lien will still be valid.

The dates and deadlines related for lien claims are based off the month and year in which the work was actually performed. The invoice date and company accounting methods are irrelevant in these cases.
Additionally, to qualify to file a lien claim on a property for a commercial project, the subcontractor or supplier, is required to send the invoice or request payment by the 15th day of the second month after the month the work was performed.
